Case Study Overview
This case study outlines a Medical Negligence claim arising from a delayed cancer diagnosis following a failure to act on abnormal test results.
The delay had significant consequences for our client’s condition, limiting treatment options and ultimately resulting in a fatal outcome.
Delayed Cancer Diagnosis
Our client attended hospital with chest pain and shortness of breath, where investigations included a chest X-ray. He was discharged with antibiotics for a suspected chest infection. However, the X-ray was later reported as abnormal, showing a shadow on his lung and recommending further imaging. Unfortunately, no follow-up action was taken and the findings were not communicated to his GP.
Over a year later, our client returned to hospital after developing further symptoms, including chest pain and coughing up blood. A CT scan revealed lung cancer that had already spread to his lymph nodes, spine, hip and other lung. By this stage, the disease was inoperable and his treatment options were limited. Despite undergoing chemotherapy, the cancer progressed and he sadly passed away the following year.
How We Helped
A Medical Negligence claim was brought on behalf of our clients’ dependants. It was argued that the abnormal chest X-ray should have been investigated promptly. Had appropriate follow-up taken place, the cancer would likely have been diagnosed at a much earlier stage when surgery was still possible.
Expert evidence supported the view that earlier treatment would, on the balance of probabilities, have prevented the spread of the disease and significantly improved his prognosis.
Case Study Outcome
The defendant admitted that there had been a failure in care, although the impact of the delay remained disputed. Court proceedings were issued and the claim ultimately settled shortly before a case management hearing. Our clients’ family received compensation providing financial support and recognition of the consequences of the missed opportunity to diagnose and treat his cancer sooner.
This case highlights the importance of acting on abnormal test results and ensuring appropriate follow-up investigations are carried out. Delays in diagnosing cancer can significantly affect treatment options, outcomes and life expectancy.
