Case Background:
The plaintiff had previously suffered an ectopic pregnancy, as a consequence of which one of her fallopian tubes had been removed.
Case Overview:
The plaintiff attended the emergency department of the defendant hospital in June 2021 following a private scan which had confirmed an ectopic pregnancy. The plaintiff previously suffered from an ectopic pregnancy and informed the defendant hospital of this. An ultrasound examination was undertaken, and the Plaintiff was advised that an empty gestational sac and a cyst on her ovary had been visualised. In view of the diagnosis, the plaintiff was advised that she had suffered a miscarriage and the miscarriage was managed medically.
The plaintiff continued to experience abdominal pain and advised the defendant hospital that the results of a pregnancy test she had taken in late June were positive. The plaintiff fell ill and was taken to the defendant hospital via ambulance. Following blood tests, emergency surgery to remove an ectopic pregnancy was performed and the plaintiffs remaining fallopian tube was removed.
Lavelle Partners obtained expert evidence form the UK in relation to breach of duty and causation and issued proceedings on behalf of the Plaintiff.
Case Settlement:
The case was successfully settled for a significant sum with costs in advance of the trial.
