Case Overview:
The plaintiff was admitted to the defendant hospital with severe pain in her right arm extending from her shoulder to her elbow. The plaintiff was diagnosed with sepsis and underwent two washout procedures in June 2021. The plaintiff was later discharged from the defendant hospital and advised to continue treatment with an oral antibiotic prescribed by the defendant hospital.
Following the plaintiff being discharged from the defendant hospital, the plaintiff adhered to the advice given to her regarding consumption of the prescribed medication. Despite her adherence to that advice, the plaintiff’s condition did not improve.
At a routine review in a separate hospital, in the aftermath of the plaintiff’s discharge from the defendant hospital, the plaintiff was advised that the medication prescribed to her by the defendant hospital did not include an antibiotic.
Upon learning that an antibiotic had not been prescribed to her, the plaintiff attempted to make contact with the defendant hospital but to no avail until early July, when an antibiotic was ultimately prescribed to the plaintiff. The plaintiff was readmitted to the defendant hospital where she remained an in-patient for 3 weeks.
Owing to the failure of the defendant hospital to provide an antibiotic, the plaintiff required two further surgical procedures, was diagnosed with septic arthritis and consequent to the improper treatment of sepsis, suffered damage to her shoulder bone.
Case Settlement:
Lavelle Partners obtained expert evidence form the UK in relation to breach of duty and causation and issued proceedings on behalf of the Plaintiff.
The case was successfully settled for a significant sum with costs in advance of the trial.
